Antiques Market of the Virginia Highlands Festival

I hereby apply to the Antiques Market Committee (hereinafter referred to as "AMC") of the Virginia Highlands Festival, Inc. (hereinafter referred to as "VHF") for exhibit space at the Antiques Market (hereinafter "AM"), for which I agree to pay exhibit fees, as set forth below. Should this application be accepted, I, as applicant dealer hereto, hereby agree to the following terms and conditions:

• 1.The granting of space pursuant to this application is a license only, revocable at the sole discretion of the AMC, if in its sole discretion the articles displayed or the location of the display or activities of the applicant are contrary to the usual business activities of the AM or good business practices generally.
• 2.The AMC of the VHF reserves the right to reject any application. New applicants are requested to submit a written description and photographs representative of the quality and variety of articles to be displayed.
• 3.If for any cause whatsoever it should be impossible to hold the AM, this license shall automatically terminate and the licensee shall waive any claim from damage except the return of a paid deposit.
• 4.Applicant's physical display and electrical arrangements and connections are subject to the approval of the AMC, but this shall not be construed so as to make the AMC or the VHF or maintenance employees in any way responsible or liable thereof.
• 5.Electricity provided shall be 300 watts per booth. All electric bulbs used must be compact fluorescent and/or LED. Surge protectors are required to be provided by and used by each dealer. Electricity is for lighting only. Microwaves, refrigerators, slow cookers and/or appliances are not allowed.
• 6.Any food dealers bring into their booths must be contained and must be removed at the end of the day.
• 7.Marked booths are 15'X15'. Dealers must stay within the confines of the marked space(s) assigned. Dealers may not exhibit beyond the boundaries of their space nor interfere or block the display of another dealer at any time. Dealer may not display merchandise or sit in the aisles, pursuant to the Virginia Statewide Fire Prevention Code.
• 8.A booth sign will be provided for each Dealer bearing the business name, town and state. No other signage/identification will be allowed at the AM.
• 9.Dealers are strictly prohibited from purchasing merchandise from the public on AM grounds during regular business hours.
• 10.Tables (8' and 6') shall be available for rent at the rate of $25.00 per table.
• 11.Dealers must collect a 5.3% Virginia sales tax on all retail sales. THIS TAX IS REQUIRED PURSUANT TO VIRGINIA LAW AND MUST BE INCLDED IN ALL RETAIL SALES. A representative from the Virginia Department of Taxation will be on site the final weekend to collect taxes. Failure to collect and/or pay taxes shall result in exclusion from any future AM shows.
• 12.Dealers shall be limited to articles suitable for and appropriate to a market for antiques. ALL ITEMS MUST BE ACCURATELY AND PROPERLY LABELED AND PRICED.Imports must be accurately identified. Any question will be resolved by the designated sub-committee of the AMC whose sole judgment of any merchandise shall be final.
• 13.The sale, trading, or showing of illegal weapons is not permitted on Washington County Virginia Fairgrounds premises at any time. Applicant agrees to comply with the Code of Virginia, 1950, as amended, 29.1, 1-553 forbidding the offering, selling or purchasing of any wild bird, wild animal, or any part thereof or any freshwater fish, except as provided by law. Any violation of this section shall be grounds for automatic revocation of this license with NO REFUNDS available.
• 14.Dealer shall not share or sublet any part of the space assigned to him/her.
• 15.A final exit plan will be distributed the last weekend of the AM. Dealers will be consulted during the week about his/her place in the exit plan. Failure to comply with the plan will result in exclusion from the following year's show.
• 16.NO SMOKING OR USE OF TOBACCO PRODUCTS shall be allowed at any time inside the building.
• 17.SET-UP DAYS ARE AS FOLLOWS Wednesday, July 25th: 8:00am through 6:00 pm (Nighttime security begins). Thursday, July 26th: 8:00 am through 6:00 pm. Friday, July 27th: 8:00 am through 6:00 pm (24 hour security begins at 6:00 pm). For security/insurance reasons no one is allowed in building prior to or after posted hours.
• 18.Security ends at 6:00 am on Monday, August 6, 2018. All merchandise must be removed from the market site by Monday, August 6, 2018 at noon. ALL SPACES MUST BE LEFT ABSOLUTELY CLEAN AND FREE OF RUBBISH. Ground cover and carpets must be properly disposed of by placing in dumpster.
• 19.Dealers must keep his/her booth open from 8:00 am until 6:00 pm on Saturday, July 28th; 10:00 am until 6:00 pm on Sunday, July 29th through Saturday, August 4th; 10:00 am until 5:00 pm on Sunday, August 5th. PACKING SHALL NOT BEGIN UNTIL 5:00 ON THE FINAL DAY OF THE SHOW.
• 20.Booths must be manned at all times.
• 21.Children must be accompanied by an adult at all times. No bikes or scooters of any kind allowed in the AM.
• 22.Pets must be kept in a kennel away from customers, always on leash when walked, and walked only in designated area at rear of building. Unruly pets will be removed from the building. Service animals will be allowed only if proper documentation/certification has been submitted along with this contract.
• 23.Deadline for application with a $200.00 deposit is March 10^th. If contract and deposit are received by this date you will be listed as an AM vendor in the Highlander publication. Applications will continue to be taken March 11^th through June 1^st and the deposit required will be $300.00, however, this will be too late to be listed in the Highlander. No refunds will be made if cancellation occurs after June 1, 2018.
• 24.NO EXHIBIT SPACES WILL BE HELD WITHOUT A SIGNED CONTRACT AND DEPOSIT. PHONE CALLS WILL NOT BE ACCEPTED AS A SUBSTITUTE FOR DEPOSIT. Only checks, postal orders, and charge cards are accepted for deposits.
• 25.Deposit must be received prior to being admitted to the grounds.
• 26.Final payments will be collected on Tuesday, July 31, 2018 and may be check, cash, charge card, or money order.
• 27.Applicant, its employers, employees, and agents do hereby and hereafter release, relieve, and agree to indemnify and hold harmless the VHF, the AMC, and Washington County Virginia Fairgrounds and the respective members, employees, agents and sponsors, affiliates and /or sponsors of and from all manner of claim, expense, cost, injury, damage, or action, whether personal or property, however arising, whether at law or equity, from the actions, display, and/or other related activities at the AM, whether by applicant, its agents, employees, customers, invitees, or business visitors. Further, applicant understands and hereby agrees that neither the AMC, the VHF, nor the Washington County Virginia Fairgrounds Community shall in any way, manner, or amount be responsible for theft, damage, or destruction to applicant's merchandise or personal property, on display or otherwise, however arising.
• 28.This application is not deemed to be a contract, agreement or license, and shall not be binding or in any manner effective until accepted by the VHF and fully executed by all parties hereto. If accepted, this agreement contains the entire understanding of the parties, there being no promises or undertakings, written or oral, other than those expressly set forth herein.
• 29.The violation by the applicant of any of the terms and/or conditions herein agreed to may result in the automatic revocation of this license and/or expulsion from the AM, at the discretion of the AMC.
